Forensic Practice in Employment Cases (Core)

Recent legal developments provide forensic psychiatrists with significant opportunities to become involved with workplace legal issues. This course, taught by an attorney specializing in psycho-legal issues in the workplace, will first examine the various employment laws that include a mental health component (Civil rights Act, Americans with Disabilities Act, common law). It will then provide a "litigation roadmap" illustrating the various points during the legal process at which the psychiatrist may make a meaningful contribution. It will also reveal numerous practical tips to assist the psychiatrist to interact more effectively with the attorney, such as budget issues, obtaining records, case formulation, preparation for testimony, etc. It will then explore several topical areas, such as the impact of the Daubert rule on psychiatric testimony, privacy and privilege issues, the importance of personality disorders in employment cases, and to what extent discovery into a plaintiff's sexual history is permissible. It will also explore key issues relating to the forensic psychiatrist's role under the ADA, such as the fitness- for-duty examination, confidentiality of employees' medical information, and the Equal Opportunity Commission's recent Guidance on psychiatric disabilities under the ADA.

Surviving Inpatient Care in Managed Care Era

Psychiatrists have certain clinical responsibilities and legal duties to patients treated in managed care settings. These include disclosures of all treatment options, the exercise of appeal rights, the continuance of emergency treatment and reasonable cooperation with utilization reviewers, each important in the management of the sicker, potentially violent inpatient. The duty to warn and protect endangered third parties will likely occur with increased frequency as cost containment measurers curtail the length of hospitalization. Competent suicide risk assessments and risk/benefit notes, particularly at the time of admission and discharge, are essential to good clinical care and risk management. Psychiatrists must be careful not to prematurely discharge sicker, potentially violent patients due to managed care pressures. Managed care organizations (MCOs) determine the extent of insurance coverage but not the diagnosis and treatment of patients. This is the psychiatrist's responsibility. Although the quality of care may be adversely affected by MCO restrictions, the standard of care in the treatment of violent psychiatric inpatients remains unchanged. New obligations created by MCOs present a challenge to psychiatrists who are treating sicker, potentially violent inpatients. These same obligations, however, can be turned into clinical opportunities that may benefit the patient.

The Psychiatrist as Expert Witness (Core)

Trial procedure and rules of evidence governing fact and expert witnesses will be reviewed briefly. The fallacy of the impartial expert will be discussed. Participants will learn that the adversary process seeks justice, sometimes at the expense of truth. The faculty will discuss prepartation of legal reports, pre-trial conferences, depositions, and courtroom rules of confidentiality and privilege. Participants will learn to cope with cross-examiners who attack credentials, witness bias, adequacy of examination, and the validity of expert's reasoning. Issues of power and control in the witness cross-examiner relationship will be explored. Participants will learn how to answer questions about fees, pre-trial conferences, questions from textbooks, and hypothetical questions. The use of jargon, humor, and sarcasm will be covered.

Different styles of testimony and cross-examination techniques will be illustrated by 12 videotape segments from actual trials and mock trials. Participants will see examples of powerful and powerless testimony in response to the same questions. Mistakes commonly made by witnesses will be demonstrated. Slides of proper and improper courtroom clothing will be shown. Handouts include lists of 60 suggestions for witnesses in depositions, 15 trick questions by attorneys, and 58 suggestions for attorneys cross-examining psychiatrists.

Correctional Psychiatry (Core) - presentation of the Institutional and Correctional Forensic Psychiatry Committee

This course is a presentation of the AAPL Institutional and Correctional Forensic psychiatry Committee. to meet the needs of a varied audience - with different levels of training and/or experience - this course will cover both basic and advanced topics in correctional psychiatry. Basic topics will include the history of correctional psychiatry and the major cases, the Prison Litigation Reform Act, integrating medical and mental health services, basic ethical issues, and the "rules of engagement," i.e., the rules and routines of a correctional environment and how the correctional psychiatrist can work within such constraints. Recent publications on the subject of "Forensic Psychotherapy" will be reviewed. Advance topics will include systems approaches and issues, managed care issues, accreditation, cross-training with security personnel and special clinical issues such as psychopharmacology in correctional settings. The faculty for this course include leading educators, surveyors and practitioners in correctional psychiatry.
